The Delhi High Court on Wednesday declined to grant a company time to sell its remaining stock of electrolyte beverages marketed as ORSL, which the FSSAI has barred from being labelled as Oral Rehydration Salts (ORS).
A bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela noted that while the product was not alleged to be harmful, it constituted a case of misbranding and could not be allowed to remain in the market, given the public health implications.
“Sorry, we can’t permit it. Please recall it (stock). We will not permit it. We are sorry. The matter relates to public health concern,” the bench told the counsel for petitioner company JNTL Consumer Health India Pvt Ltd.
